Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Lana, including our website at lanatrips.com, our iOS and Android mobile applications, our Chrome browser extension, and any related tools, services, documentation, and interfaces (collectively, the “Service”). The Service is operated by Lana Labs, LLC (“Lana”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility; Account Registration

• You must be at least the age of majority in your jurisdiction to use the Service.
• You may create an account using an email and password, or by authenticating with an existing Google or Apple account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You agree to provide accurate information and to keep it current. We may suspend or terminate accounts that are inaccurate, incomplete, or that violate these Terms.

2. Subscriptions, Billing, and Renewals

The Service may be offered on a subscription basis with different features or usage tiers. You can purchase a subscription via: (a) the web using Stripe; (b) Apple’s App Store on iOS; and/or (c) Google Play on Android. Unless otherwise stated, subscriptions renew automatically at the end of the billing period until canceled.

• Platform billing. Purchases made via Apple’s App Store or Google Play are billed by the respective platform and are subject to that platform’s terms and policies. Web purchases are processed by Stripe and are subject to Stripe’s terms.
• Cross‑platform access. If you subscribe through Apple’s App Store, your paid entitlement will also unlock the corresponding subscription features on the web app for the same Lana account (for example, when you sign in with the same email or linked SSO). We may prompt you to validate your purchase receipt to enable cross‑platform access.
• Free trials. If provided, trials convert to a paid subscription unless canceled before the trial ends. Eligibility for trials may vary.
• Cancellations and refunds. To cancel: (a) for web purchases, manage your subscription through the web account settings; (b) for Apple App Store purchases, use Apple’s subscription management; and (c) for Google Play purchases, use Google Play’s subscription management. Refunds are handled per the applicable platform’s policy and our applicable policies.
• Price changes. We may change prices or subscription features prospectively. Where required, we will provide advance notice or obtain consent before changes take effect.
• Taxes. Prices may not include applicable taxes, which may be added depending on jurisdiction.

3. License and Acceptable Use

Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for your internal purposes. You agree not to:

• resell, sublicense, or otherwise commercialize the Service except as expressly permitted;
• reverse engineer, decompile, or attempt to derive the source code, except to the extent permitted by law;
• access the Service or related systems in order to build a competitive product or service;
• circumvent security, rate limits, or access controls;
• use automated means (e.g., bots, scrapers) that unduly burden or interfere with the Service;
• upload or transmit malicious code or content that infringes or violates rights or laws; or
• misrepresent your affiliation or interfere with other users’ use of the Service.

4. User Content

You may submit or upload content to the Service (e.g., receipts, statements, documents, images, annotations) (“User Content”). You retain ownership of your User Content. You grant Lana a worldwide, non‑exclusive, royalty‑free license to host, store, process, display, and transmit User Content for the purpose of providing and improving the Service and as otherwise described in our privacy disclosures. You represent and warrant that you have all rights necessary to submit the User Content and that your User Content and its use with the Service will not violate any laws or third‑party rights.

5. Privacy and Data

We describe how we collect, use, and protect personal information in our Privacy Policy. By using the Service, you consent to those practices. You can request deletion of your account and data via the Delete Account page or as otherwise provided in the Service.

6. Third‑Party Services and App Stores

The Service may integrate with third‑party services (e.g., Google, Apple, Stripe, Firebase) and is also distributed via Apple’s App Store and Google Play. Your use of those services may be subject to additional terms and privacy policies of the third parties. To the extent of any conflict, the third‑party terms may control with respect to their services.

7. Chrome Extension

When you install or use the Lana Chrome extension, you grant it the permissions disclosed in the Chrome Web Store listing. The extension may read and modify content on specific sites to provide functionality you request, consistent with these Terms and our privacy disclosures. You can disable or remove the extension at any time in your browser settings.

8. Intellectual Property

The Service, including all software, interfaces, designs, and content (excluding User Content), is owned by Lana or its licensors and protected by intellectual property laws. Except for the limited license granted above, we reserve all rights.

9. Feedback

If you provide suggestions, ideas, or other feedback, you grant Lana a perpetual, worldwide, royalty‑free license to use and incorporate that feedback without restriction or compensation.

10. Beta and Experimental Features

We may offer beta or experimental features that are provided “as is,” may be subject to additional terms, and can be modified or discontinued at any time.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if we believe you violate these Terms or if we discontinue the Service (in whole or in part). Upon termination, your right to use the Service stops immediately, but sections intended to survive (including those on intellectual property, disclaimers, limitations of liability, and indemnification) will continue to apply.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR‑FREE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANA AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LANA FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

14. Indemnification

You will defend, indemnify, and hold harmless Lana and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.

15. Export and Sanctions

You may not use, export, or re‑export the Service except as authorized by United States law and the laws of the jurisdiction in which the Service was obtained. You represent that you are not located in a country subject to U.S. sanctions and are not on any U.S. government denied‑party list.

16. Governing Law; Venue

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of laws principles. You and Lana agree to the exclusive jurisdiction and venue of the state and federal courts located in New Mexico for any dispute arising out of or relating to these Terms or the Service.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms and updating the “Last updated” date above. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
